​​​FSBO GUIDE

Your buyer client may tell you they found a For Sale By Owner (FSBO) that they want to look at. Most agent’s initial reaction is that they won’t get paid on a FSBO. The fact is that a majority of FSBOs actually would be glad to pay you a commission of 3.5% or less (You negotiate this), but you have to get in front of it quickly or they will call the FSBO themselves.

If your client wants to see a FSBO get the contact info for the FSBO and call/text/email the owner and say this: "I have a buyer that I think would like your home. Would you be willing to pay my firm a commission of 3.5% of the sales price if I sold your home to them?”

If they say no, then just say “Ok, thank you for your time.” (short, sweet, always diplomatic!)

If they say YES you absolutely MUST have them SIGN an UNLISTED PROPERTY COMMISSION AGREEMENT BEFORE you even show the house.

If your client DOES like the house and wants to make an offer EXCELLENT! You just took a FSBO off the market! Read below and follow the steps for a successful sale.

If your client DOES NOT like the home EXCELLENT! You have an opportunity with a person trying to sell their home FSBO. Maybe you can get the listing. Follow these steps:


1) ALWAYS be diplomatic and complimentary when talking with the FBSO
2) Give them feedback from your showing
3) Offer to help. Do they need disclosures? LBP? PICS? Remarks? How can you HELP?
4) Stay in touch! FB friend them…try to show it to another client.. follow up and ASK if they want your help. NEVER burn a bridge. Maybe they don't list with you, but maybe you can help them buy their next home if you were so helpful on their FSBO.


Once you write an offer and negotiate a SALE you will be ready to start the process and these are the steps:


1) Present the seller with our FSBO Processing Form. This gives them an option for RE/MAX REVOLUTION to process the needed steps to sell their home for an additional $1295. Some FSBO have no idea what they need to do next except hire an attorney. We can FACILITATE the processing of their sale WITHOUT REPRESENTING them (but they won’t have to hire an attorney for the deed package) They are not your CLIENT they are our customer.

2) Provide fully executed PA & Disclosures to the seller

3) TURN IN YOUR SALE. You will need these items turned in:

  • Unlisted Property Commission agreement signed by seller
  • Seller opt in or out of FSBO Processing Services Form signed by seller
  • First three pages of the Listing Form no signatures required
  • DO NOT NEED the fourth page of Listing Form (contract) no signatures required
  • Fully executed Purchase Agreement signed by BOTH buyer and seller
  • Fully executed FSBO Seller Disclosure  signed by BOTH buyer and seller
  • Fully executed FSBO LBP (1978 or older) signed by buyer and seller, initialed by agent
  • Fully executed addendums if applicable signed by BOTH buyer and seller
  • Buyers agency disclosure signed by the buyers ONLY
